In a auto accident.. Please help!!

I was recently in a auto accident that was not my fault at all! The car i was driving was my step dads car, and i am an excluded driver from his insurance. The guy who hit totally lied to his insurance and said it was my fault, i went to take pictures of my car as his insurance requested they called me and sent me in the mail informing me that with the picture they have received of the damaged they cannot tell who hit who, therefore they would not cover my damages. Now 2 days ago i get a notice in the mail saying i need to pay or 1900 for the damaged I caused to his 1992 Toyota pickup or offer a settlement. however he did have liability along with uninsured motorist. Can they actually do this if they told me that no one was at fault. Since his insurance is sueing me, do i sue them back for not paying and then sue him for the damages to my car ? Someone tell me if im screwed or what you would highly recommend?

  1. doesnt matter if its your fault or not you were excluded that means you are not covered no matter what aka u shouldnt have been driving that vehicle. you are responsible for that. if you lived in my state you would be arrested for not having insurance. if i were you i would settle out of court before you get serious fines and possible jail time. sorry you have no case whatsoever.

    go ahead and fight it in court. tell the judge you were driving without insurance and to top it off were excluded from driving the car (that means you are NOT to drive the car)


  2. If he didn't have collision, his company shouldn't be involved in any way with the damage to his truck, therefore they shouldn't be sending any letters in that regard. If he is claiming injuries, that's where the uninsured motorist coverage is involved.  Maybe the letter is from his agent who is getting involved where he shouldn't be.  If his company finds out you are uninsured you may lose your license.  The best deal might be to forget it and hope they do to.
