i was in a car accident last week and my car was rear-ended, plus i dislocated my shoulder. the other person was at fault. instead of just allowing me to drop car off and have a rental for a few weeks, the other person's insurance agency, allied/nationwide wants me to take my car in 3 separate times.. 1) make it safe to drive 2) paint 3) parts. they wont give me a rental so i had to find a collision place that had shuttle services, which won't help me get from one place to the next (school to whereverer...)

i have school finals next week and school starts again the following week. i have doctor's apts, plus if i don't work i won't be able to pay rent and my employer has already said i can only have 2 more afternoons off and then i need to have everything fixed. the collision place is an hour away from me, so i have to take at least 4 hours off at a time to have my car fixed. this is all through the other person's insurance agency. i have already taken one day off from work to get a quote for the adjuster...

my insurance agency says state laws in colorado say they cannot represent me....

how do i get the other agency to cover the cost of the rental for the full 3 weeks it will take to repair my car? i already have to take time off from school to go to the doctor and physical therapy.. i went through my health insurance instead of filing the paperwork for the other person's insurance to pay my medical expenses.

i really have no alternative... bumming rides and having shifts covered will not help me.

  1. Get an attorney. You will recover at least $10K especially if they are at fault.  


  2. I would get me an Attorney and I would tell Allied that I am going to do such.  You have a cut and dry case.Try to find a good one that does not collect from you unless the Attorney win your case.

  3. Are you OLD enough to rent a car? You are not allowed to rent a vehicle in almost every state until you are age 21. If you ARE over 21 then get the manager of Allied on the phone and respectfully demand they provide you with a rental while your vehicle is under repair. Not to be as *** but this is why you need to cover yourself out there in the concrete jungle with adequate insurance coverage and rental policy. Sure it's going to cost you some extra money but you can avoid so many headaches by simply using your own company in case of a loss.

  5. Your agent is correct. They can not "represent" you. Only lawyers can do that.

    Insurance is regulated at the state level (not federal).  So, if you are not happy with how the other company is treating you - contact your states Department of Insurance. They should have a consumer complaint line. Many Insurance Departments have web sites where you can file your complaint on line.

    If the other company has spoken to their driver and confirmed liability - they should provide a rental while your car is in the shop. They won't pay for any extra insurance/fuel charges but should pay the daily rate and tax for basic transportation. (But I don't work in Colorado so there could be something crazy with their laws).

    I recommend you contact the Department of Insurance and file a complaint. The DOI will contact upper management at the at fault carriers company and make them respond. The DOI also knows the state laws regarding rental cars.

    EDIT: What the claims cowboy is telling you to do is another option. If you get tired of dealing with Allied and have collision coverage on your vehicle - you can use your collision coverage to get your car fixed. Your company will then pursue Allied for the money they paid and your deductible. Once your company gets paid - they forward your deductible onto you. The process is called Subrogation.

    It can be a very good alternative. People often feel more comfortable dealing with their own insurance company. Or, they get tired of waiting around on the other carrier to make a decision.
