In a child custudy case do you have to let the other parent have visitation?

the other parent has warrents for unpaid support and only calls the children once in a great blue moon, we live 5 states away and i 'm sposed to let him have them over summer and over christmas break ....do i have to let them go if he hardly calls and even ask about how their doing ? the kids are 9and 11

  1. If it's a court order and you signed it, then yes.  If he is supposed to visit with the kids and wants them, and you don't send them, you will be in contempt.  You can't decide whether or not he's worthy to see the kids. Only the courts can do that. You can ask an attorney for advice, but till you get a judge to say he doesn't get to see his kids anymore, you have to send them or be in trouble yourself.


  2. if the other parent wants to use their visitations right, they have that right to do so..let them take you back to court since you stated that they don't really have a relationship with the children. things like this is better served in court since the children are younger and of course they haven't had much of a relationship with their father, which they may very well feel uncomfortable being around him at first..let him make the request in court and then you can seek what is best for the children due to his lack of being in their lives.

  3. This is a lot like my moms problem. If he doesn't pay child support, then you can go to court and tell them that he isn't, and they'll trace him down and take the money and give it to you, if he doesn't call and ask them to come over, or make plans to pick them up, just assume that he doesn't want them over. Go to court and ask them about it and tell them he hardly calls, also, ask your children what they want. That's an important part. If they want to go see him, let them, but if they don't, you have a right to let them not go. when the oldest turns 13, she or he can officially say it and your ex can never make him or her go again.
