In a state where the consent to adopt forms are signed...

I was asked if the normal consent to adopt is over in 10 days, could the placing parents, and the adopting parents agree to a longer period of time for the consent to adopt forms to be over with? I just need to know if it's legal, I realize the consequences, and I know why it's harder on both sides. Can this legally be put into a longer time before proceeding with the adoption, without having to do a guardianship, then adoption?

  1. If you are thinking that consent to adoption forms "must" be signed within a certain timeframe, and many natural mothers are told they "must" sign at the 24 hour, 72 hour, 10 day, or whatever point, that is wrong.

Those are the "miminums".  A mother can hold off signing for as long as she wants to. Example: she can take her baby home with her while she makes a decision.  It is her baby and she has this right.  There are organizations that can loan her what she needs while she decides if she has bought nothing during her pregnancy.

There is nothing saying she "Must" sign at a certain point, even if agencies and lawyers hound her to do so.  They are in it to make money.

  2. there are a few ways that this could go,

once consent is granted the birth BIRTH PARENT legally have a six month recall period to change there mind.

this can even be extended if they can afford the legal fees.

the answer you are looking for is YES, the birth mother has more right then the adopting mother.
