I work for a church preschool in California, we have always got a monthly salary and this year we have to clock in out. I am wondering if this is an actual law, that is what our boss told us.

  1. It depends how many work there.

It also proves you are getting your lunch breaks under Federal labor laws.

  2. I didn't think that the law was different for non-profit.  I believe California law is that regardless if you are an hourly/salary, you still have to keep time card records.  Where I work you have to use vacation/sick leave/docked if you are salary and take time off, the only difference is you have to take it in full day or half day increments, not hours. So I don't think that's a simple test.

  3. The church can avoid paying overtime only for bona fide executives.  There are several tests for who is exempt, but the point of them all if the the employer cannot treat you as hourly for some purposes and as salaried for some purposes.  Here is a simple test:  If you take off for less than one full day, say 7 hours, do you have to account for that with vacation time or sick time or getting docked?  If so, you are an hourly worker and they must keep an accurate record of your time and must pay overtime.
