  1. yes. this is not like castling. if a player is in check, and has the ability to capture an opponent using en passant, and at the same time block that check, then yes, he may do so.  It would be your fault for not seeing that your move putting him into check, still leaves en passant as an option for your opponent.

  3. Yes, capturing en passant is a legal move to get out of check, but Yahoo chess doesn't allow it.  There is a bug in Yahoo that prevents such captures.  The bug has been around for at least a couple of years and, as far as I know, is still uncorrected.
