which goes to prove that finding 4 males to witness is going to be an anatomical impossibility which means the rapist gets awat scot free and the woman who gets raped always gets charged for Adultery

You are misinformed, obviously.

The four witnesses who need to have witnessed the actual penetration are needed to prove that two people have committed adultery. If an accuser accuses two people with adultery without having 4 witnesses, the accuser will be in trouble and will get lashed.

Raped women are not judged (according to Islam) for they didn't do it according to their will and adultery is the act of sexual intercourse between two unmarried people when they both intend to do that willingly.

In islam, rape is not a big deal. As long as you do it discreetly. That is why the Quran itself mandated the 4 male witness. Even then, the women who was rape is not the victim but the accused. She will get punished along with the men that rape her. This practice is very islamic and it is a mandate directly from the holy Quran.

unfortunately the criminal law regarding rape are twisted....  whilst islam it is true it is indeed difficult to prove rape... however  in more developed islamic countries like for eg dubai they are being stricter and in fact do not so put so much burden of witness as evidence but are moving more to actual fact and medical testing...

having said that it is not fair and it is indeed difficult and even more so unfair to a muslim girl who has infact need to show her purity on her first night of wedding...

however don't think it is any easy in any country.. while we might not need witnesses, the laws regarding rape leave much to be desired.. because one side you have a girl who has been raped, but on the other hand you cannot risk having girls calling rape to take revenge...

apart from that there is always the emberassment factor, the reliving the trauma...

all legal systems have different requirement, some say any penetration without consent, others say penetration with violence... either way they are soo hard to prove...

soo unfortunately b******s get away with it... but having good legislation on rape is difficult...

however i might be able to explain the 4 witnesses in islam because, presumably 1) the girl or woman should have not been out unattended...2~) infact if she was she would have made enough noise for others to hear her.

however as i said as far as i know in dubai and indian was sentenced to death for raping a girl.. so maybe things in some places are moving.
