2nd degree felony, larceny felony,stolen property receiving and concealing misdemeanor.He claims he borrowed the a playstation and all the accessories from his 10 yr. old friend but later found out that it was stolen from someone,s home.

  1. No. the child is charged and released into the custody of the parents till a court date is set.


  2. It depends. First time offense, more than likely not. Generally when a parent is charged with the crimes of the child it is because there is a pattern of behavior and the judge/law enforcement can not show that the parent is doing anything to stop the behavior. Example: a 15 yr old breaks into a home once, the parent most likely will not be charged. If a 15 yr old breaks into a home and has been caught doing it previously, the parents can be charged. If, on those previous occasions, the parents can show they've taken steps to attempt to stop the behavior (i.e counseling, voluntary commitment etc.) a judge will not charge them.

    That being said, I have seen some instances in which the parents attitude of the crime has landed them in trouble with the law. The more accepting they are of the child's criminal activities, the more likely they are to be in trouble as well.

  4. In this situation, the parents are not criminally responsible for the acts of their children.  The 15 year old may be charged in juvenile court.
