In need of a good cops help.?

OK, I turned down my road and 3 officers were standing in the road blocking the way. (they were 50 feet from my house.) the female officer said no that they were doing seatbelt checks and registration checks. she said I was good then said I have a crack in my windshield and she needs to give me a ticket. she asked me to pull over. I said you have to be kidding me and did pull over, she asked for my license, registration, and proof of insurance. I gave her these and explained to her that I had just had it replaced and it was a stress crack from being improperly installed. I then showed her the appointment card that said that I have an appointment for Monday morning for them to come and fix it. (do have a crack in the windshield that is well below the wiper line) I told her that my insurance company had said that as long as it wasn't in my line of sight it was fine. she never answered my question and walked across the street and wrote me a ticket. I then sat there for a few minuets.

  1. The police officers were entirely correct in their behavior toward you.

    You were way out of line.

    You are very lucky the police let you off that easy.

    From your description I would say that the police sergeant was entirely correct to say that you were under arrest for resisting arrest and reckless endangerment.

    If I were on a jury trying this case and you presented the details that you have given us in the additional details I would vote to convict you of both resisting arrest and reckless endangerment.

    I recommend that in the future that if you receive a ticket that you do not think is correct that you present your defense to the court. You do not argue with the police officer who gave you the ticket.


  2. Plead not guilty to the ticket in court.

    Show the judge your paperwork that you've had it fixed.

  3. So in other words, you were legally stopped by an officer for a cracked windshield.  Your insurance company lied to you when they said it doesn't matter out of the line of vision.  You were then given a fix-it ticket, which would be dismissed after you proved you had it fixed.

    You then caused a disturbance in the area which initiated a response from the other officers, then called 911 for a non-emergency and created more of a problem?  

    WTF for?  Just take the ticket, get the windshield fixed and quit whining.  I don't believe the rest of your story, as it doesn't flow right, is jumbled thoughts put together, and seems to be missing pieces.

    You caused the problems in this story...100%.  Learn to control your mouth and your life will be a lot easier.

Get a good lawyer.  See if you have a case and if they can prove it then sue the h**l out of them.   I hate it when cops act more important than they are.   They start thinking they can treat people however they want to.  h**l they are out there tazeing old ladies, little kids, and pregnant women.   They need to be taken down a notch.  Good luck.

  6. In California...The crack doesn't have to be in your line of sight to be a violation.  The point being, the crack has completely weakened your windshield making it that much easier to blow shatter something hits it right.  No biggie, they're fix-it tickets.

    As far as the officer's attitude, based on your account, he was wrong and should have shown more courtesy.  At my department, refusing to get a supervisor or not giving a citizen a card with my name and badge number is a pretty serious policy violation that would result in discipline.

    Guess I answered before you finished this huge question.

    I need to say that arguing on the street with an officer is never a good idea.  Take it to his supervisors and up his chain of command if you want satisfaction. Getting into a "pissing match" on the street will only lead to you losing.
