In personal injury cases in the uk,how does the insurance company access the amount in damages?uk

Does the insurance company go on all the reports that is received or just access you on their own doctors report?Their own doctor is not going to say their is much wrong with you in their report.

Do the barristers know each other and do they agree on a figure that each party is happy with?

  2. In my experience, no, they do not know each other.

    You have to see a doctor agreed upon by both parties, so i.e the people you are trying to get money from have to approve too, so that bias cannot be claimed. They should arrange for you to see a doctor close to home and will claim for any money you lose if you have to have time off work.

    Once the report is produced, your solicitors will make a recommendation and if you are happy with what they suggest, they will submit that to the other side and they can say yes or no. If yes, all is fine but if no, you can negotiate.

    It is worth doing if you have had an accident not your fault and you were injured.

  3. They go for as much as they think they can get away with.  They will have dealt with so many cases they get a feel for how much they can push it.
