In the State of NJ if the age of consent is 16, is it legal to have s*x with a 19 year old?

my boyfriend and i re sexually active, and ever since his mother caught us in te act, she dosent want me over there with out supervision. hes 19 and im 16, but since im at age of consent shouldnt it be okay?

You are right, the age of consent is 16 in NJ.  Basically the law states that it's 16 for consent and there can't be an age difference of 4 years or more.  If your BF turns 20 while you are still 16, he can be charged.  The laws dealing with age can be tricky.  Someone correct me if I'm wrong, but I think your mom can press charges since you are not an emancipated minor, meaning you are still under your mom's care and protection.

  3. The age of consent in New Jersey is 16. At 16 you can legally have s*x with anyone you want. That means that having s*x with your boyfriend is "legal" - it does not mean that it's "okay".

    It's his mothers house, she makes the rules that apply there. If you were both in your 30's and she didn't want you having s*x in her home, that's her right.
