  3. Um, NO!  There is such thing as colored contacts lenses, bad lighting....people who lie on their driver's licenses...etc.

  6. No you can not get it thrown out. As you already know, often green eyes look brown depending on the light. Good try though.

  7. No, it's a simple "clerical error". Also your eyes may have looked brown to the officer. My eyes are listed on my DL as BG for Blue-Green, but often look only blue or green depending on what I'm wearing or near. My hair varies between blond and light brown depending on if it's summer or winter.

  8. No, but it's possible you could use it to create reasonable doubt. Suggest that the officer wasn't careful or depending on the circumstances that it was a case of mistaken identity.

Sorry - police are allowed to make errors on paperwork, it's called human error for a reason.  The CJ system is full of cases with inconsequential mistakes - although the importance of these details will vary from case to case (if it's a complaint between strnagers, obviously ID is an issue and eye color could matter; a complaint between known parties obviously makes that insignificant).  Depending on the circumstances, such errors would not only be forgiveable but expected.

    Sorry, but the so-called technicality doesn't exist.  It's either plea-bargain or trial for you.
