  1. No, wages can not be garnished in the State of Texas for repossessions.

    What they can do if they take you to court and get a judgment is attach bank accounts and file liens on any other property you may own like cars, boats, land and homes.


  2. If the loan company takes you to small claims court and gets a judgement for the amount still owed, yes they can at that point garnish your wages. Until they get a judgement, they wont be able to garnish your paycheck

  3. they got the car back and your credit is crummy.  they aren't also going to go after more money unless you want the car back and are prepared to pay penalties etc.

At present four U.S. states North Carolina, Pennsylvania, South Carolina and Texas do not allow wage garnishment at all except for debts related to taxes, child support, federally-guaranteed student loans, and court-ordered fines or restitution for a crime the debtor committed. Several other states observe maximum thresholds that are lower than the 25 per cent maximum provided by federal law. All other states allow wage garnishment for all money judgments.

    So no they cannot garnish your wages.
