In the state of Texas can they take away my mom's home when she dies if the title is transferred to me?

My husband wants the title transferred to our names since we will be moving in. We will be making renovations,installing central air, etc. The house is paid off,no back taxes, no liens. I don't know if should go to a real estate attorney, title company, or what? She spent less than 120 days in a nursing home last year (medicaid/medicare), can they still claim her home when she dies. We don't want to move in and update the house just so they can put a lien on the house and remove us from the home when she passes away.

  1. You are speaking about a lien against the property to pay for her stay in the nursing home.

    I take it that her stay is not covered by her insurance?

    One way to fix this is to transfer the deed into your name now, while she is alive. Contact a Real Estate attorney, they are going to be able to tell you the best way to go about this in your area.

  3. I am confused. If the title is legally transfered to you and your husband, and the house is paid, why would they take it away?
