I told my friend an he will not believe me about it an it is also a question that we couldn't figure out with my friends I said yes its still considered rape but I am not quiet sure am I right

No it's not illegal age of consent is 16 or 17 but you're not an adult until you're 18 so you're safe until you turn 18 and then after you could be charged with statutory rape. I'm pretty sure that's how it works.

if the s*x was consensual then they haven't done anything illegal.  That doesn't mean that her mom or dad won't blow a gasket and make his life h**l.

fwiw:  age of consent in TX is 17 and she is below the age of consent--HOWEVER, he is only 2 years older than her--the limit in TX is 3 years between the participants.

if the s*x was not consensual then it doesn't matter how old he is--it's rape--no statutory about it.

and in TX it's not "statutory rape"  it's "indecent liberties with a minor"--it's a law directed to pedophiles.

If you're caught or turned in by her parents, it will be considered rape and you will be tried as an adult.  She's not passed the age of consent
