Need more info.  Do you (or someone) have a lease and does the lease stipulate that you can sub-lease and collect rent.  Does any of the rent from the roommate go directly to the landlord, and in fact does the landlord even know about the arrangement?  If this is a verbal sublease that nonetheless is approved by the landlord and everything is above board, then yes they do have to give notice (maybe 30 days - depends where you are).

    If this is you leasing a place and then telling your buddy, hey why don't you stay here with me and we'll split the rent - the landlord won't care.  Then you really had no right to sublease the place to begin with so the roommate has no obligation to give you notice.  

    If this went to court I suspect the roommate would say you never agreed to stay there and it was agreed between you that this was temporary, and stuff like that; and it'll be tough for you to prove otherwise - so you'll lose the case.  Sorry thats just the way it will probably be perceived.
