What are rights of person who has Indian dual citizenship and wants to marry a non-Indian (foreigner) IN India?

  1. Firstly clarify what do you mean by Indian Dual Citizenship ? There is no such thing as Indian Dual Citizenship,who ever told you this has misguided you either you are Indian Citizen or person of Indian origin having citizenship of some foreign country. Better clarify your proper identity as mentioned in the documents you have & then ask about other issues. As far marriage between Indian Citizen & foreigner in India is legally possible according to Civil form of marriage under the Special Marriage Act,1954 in India & under the Foreign Marriage Act,1969 in any foreign country. Even a Foreigner but Person of Indian origin can marry in India with a foreigner under the Special Marriage Act,1954 in India but not under the Foreign Marriage Act,1969 in any foreign country as one of the person in such marriage has to be Indian Citizen. In simple word two foreigners can marry in India under the Special Marriage Act,1954 but not under the Foreign Marriage Act,1969 in a foreign country. EDIT:- This what I told you that two foreigners (not Indian citizen) can marry in India according to Civil form of marriage under the Special Marriage Act,1954 before the Marriage Officer of the District where either of them have been staying for 30 days or more by giving one months notice for the marriage & getting married after one months notice in presence of 3 witnesses by the Marriage officer who issues a valid marriage certificate about there marriage which is legally recognised by US government. Engage a lawyer for all this job.
