Indian National getting Married to a French National?

I am Indian National planning to get married to a French National in a montsh time in France. In order to get married the Townhall in France gave me a notice for the Indian Consulate in New York to put it on the notice board. But they say that they dont provide this service. I am in a fix now as if they dont do this I can not get married in France. Please advice.

I need not have to go in much detail with regard to various conditions & procedure for such marriage between an Indian Citizen with a foreign national in any country other then India but let me tell you any such civil marriage CAN BE SOLOMINISED BY THE MARRIAGE OFFICER IN ANY FOREIGN COUNTRY UNDER THE FOREIGN MARRIAGE ACT, 1969. Foreign Marriage Act, 1969

    [Act No. 33 of 1969 dated 31st. August, 1969]

    An Act to make provision relating to marriages of citizens of India outside of India. Section 4 of the Act provides:- Conditions relating to solemnization of foreign marriages

    A marriage between parties one of whom at least is a citizen of India may be solemnized under this Act by or before a Marriage Officer in a foreign country, if, at the time of the marriage, the following conditions are fulfilled, namely:-

    (a) neither party has a spouse living,

    (b) neither party is an idiot or a lunatic;

    (c) the bridegroom has completed the age of twenty one years and the bride the age of eighteen years at the time of the marriage; and

    (d) the parties are not within the degrees of prohibited relationship;

    Provided that where the personal law or a custom governing at least one of the parties permits of a marriage between them, such marriage may be solemnized, notwithstanding that they are within the degree of prohibited relationship.

    Section 3 of the Act provides:- Marriage Officers

    For the purposes of this Act, the Central Government may, by notification in the Official Gazette, appoint such of its diplomatic or consular officers as it may think fit to be Marriage Officers for any foreign country.

    Explanation.- In this section, "diplomatic officer" means an ambassador, envoy, minister, high commissioner, commissioner, charge d'' affaires or other diplomatic representative or a counsellor or secretary of an embassy, legation or high commission.

    Now coming to you case, you are in such a big country i.e. France where we have our full fledge Indian High Commission having number of officials including the High Commissioner & now this Indian High Commission in France is telling you that they are not having facilities of getting India citizen married in France, just go & meet the High Commissioner out their & show him this provision of the Act I have mentioned you here, still if he fails to get you married under this Act, ask him what is the reason for his refusal as its your legal right to get married under this Act & know why your legal right is denied to you the information you seek under the provisions of the Right To Information Act,2005. Just tell the High Commissioner or his assistant whomever you meet that this issue you will be raising in the Supreme Court of India by filling a civil writ against the Government of India & involving the whole staff of the High Commission of India in France. I tell you all these bureaucrat come to terms only when they are shown the doors of the judiciary otherwise they are good for nothing sitting, eating the salaries in high five/six figures & enjoying life in the foreign country.

  3. Inform the Consulate that the posting is needed for your marriage and it is their duty to allow you for the said action.
