Info on auto accidents and the insurance?

I would like to know that if your in a car accident after you pip is exhausted can your lawyer have the other insurer pip cover your medical expenses. Also on most insurance policies isn't the bodily injury coverage any where 100,000 and 300,000. The reason for this question is my insurance company wants me to pay for my shoulder surgery out of my settlement.

  1. PIP is only for occupants in your vehicle.  Any medical now or future will be taken from your settlement.

    FYI, not all coverage is 100/300


  2. no, you are not able to use his PIP for your injuries.

    You would have a bodily injury claim with his policy.  Also most people do not have 100k or 300k policies as everyone wants cheaper rates and don't  insure for catastrophic losses.  That  only happens  to other people.  You'll be lucky if they carry 50k.  Remember there is always a potential for a Underinsured motorist claim  against your own insurance.  I'm sure your attorney has already put them on notice.

  3. PIP is for those that are in your car. You can not file against the at fault parties PIP once yours is exhausted.

    If the shoulder surgery is an injury from the car accident - then yes, you would reimburse the medical providers from the settlement proceeds.

    Once settlement is reached - your lawyer will subtract his fee (usually 1/3). Then the medical providers are paid. You get what is left.

    Since you have hired an attorney - you really should be addressing these questions to him. You will be paying him a very large chunk of any settlement you get. You hired him to handle your claim. That includes answering questions about it.

    I have just had back surgery after a crash and if I get a claim, all my expenses will be taken out of my settlement. Things like doctors, specialists, physio and any rehab you might have are typically taken from your sum.

    Your solicitor should make sure that you get an amount that will cover any further treatment that you need, or include further treatment in your judgement, as normally once you get a settlement, you have to pay for all your own treatment.
