Injured in car accident-question about insurance?

I'm only 18 and am really confused on how this whole injury claim deal works out. In May I was in a car accident and my boyfriend was the one driving. It was raining and he was speeding, the car went out of control, flipped and hit a bank. A piece of glass sliced my wrist damaging my median nerve and some tendons. I had surgery to repair them, but I will need additional surgery in August. This injury has caused me to be unemployed because I have no use of my right hand. I know insurance will handle my medical costs, but will I be getting anything from time off of work?

  1. If you missed work because of your injury -- then you will need to supply a letter from your employer stating what days you missed and how much you make.

    If you are saying that you got fired b/c you could not use your right hand, then have your former employer put that in writing and how much you made and how many hours you worked.

    The insurance company will consider the medical bills, lost wages, pain and suffering.

    However, the most they will pay is the per person limit of bodily injury liability coverage.

    I suggest you stay in contact with the adjuster handling your claim. Keep him/her informed of your injury treatment and medical bills.  If the adjuster starts to get concerned that the bi limits are not enough to adequately compensate you for your claim, then they should give you a heads up and tell you to report the claim to your Under-Insured Motorist carrier (if appropriate).

    The adjuster will be able to walk you through the process but you have to stay in contact with them and keep the lines of communication open.

Insurance coverage is some what different depending on what state your in.  In Calif., if your not on your boyfriends insurance policy, your entitled to OBI coverage (Occupant Bodily Injury).  Your considered a victim just as if you were in another vehicle that he hit.  With the injuries you suffer from & will be affected by for life, you have a good chance of getting the policy limits.

    If the adjuster your working with now hasn't offered this coverage, you need to ask for it!

Yes, it appears that you are tort eligible and you should be compensated for your "pain and suffering" as well.  Once you have reached a medical end result, your claim will be evaluated.  The adjuster will include the medical expenses and your lost wages.  Hopefully, your boyfriend has adequate liability coverage.  Do you know if he has PIP coverage?  This coverage pays for lost wages and medical expenses too.

    If you do not have an attorney, you can call the adjuster and find out if they will advance you a portion of your lost wages.  If they do, this amount will be deducted from the total settlement.   Not all insurance companies will advance payment, but some do to maintain the direct deal relationship with the claimant.
