Injury settlement????

My mother is going for a meeting about a settlement for my 12 yr. old brother who was in a wreck and she really has know idea what to try to get. A 18 year old boy picked him up without concent and wrecked and my brother had a broke collar bone, ribs, and some head injurys. Any idea what she should try for?

  1. How severe were these fractures?  Did they require surgery?  What kind of head injury?  Minor concussion? Coma?

    Who is she meeting with?  Is this a mediation?  She cannot ask for more than the policy limits, and I suspect that the driver had compulsory limits only since he was only 18 years old.  

    Sounds as if your brother was not wearing his seat belt.  Any settlement MAY be reduced by his own percentage of negligence.  Even a 12 year old should know that a seat belt is worn to prevent severe injuries.    

    In most states, a judge will need to approve of the settlement anyway.  The settlement will likely be placed in an annuity or savings account until he reaches 18 years old, or the age the judge agrees to let him have his settlement.
