Question:

Innaccuracies on my speeding ticket. What do I do?

I received a speeding ticket in my rental car in a construction zone going 83 in a 55. The signs say When workers are present. The officer checked the box that said workers were present however there was no one in sight. Once I saw that he did that I immediately turned around and went back to the place where he stopped me and took pictures with a time and date stamp on my camera. He also put that I had 2 passengers when I had 3 as well as he put that my car was burgundy when it was a bright candy apple red. It was the middle of the day I don't know how anyone could mistake that color. If he can't get any of that information right how can I know that my speed he stated was correct? I know that when workers are present fines are doubled but if I have proof then what are my options. I know I have to go into court and intend to but will they dismiss it for incorrect information or will they reduce the fine or will they offer me defensive driving, etc...??? Please help. Thank you

  1. The two thing that will hurt you are (1) speeding and (2) construction zone, it is pretty basic and if you try and fight it you will loose and as for the errors on the ticket you can forget about that.


  2. I would contest the allegation in court. Inaccuraccies will make the ticket void.

  3. You really should hire a traffic ticket specialist to help you. The cost for the specialist will likely be higher than the cost of the ticket, but will save you a lot in insurance. The mistakes will likely not help you at all. A friend of mine went to court for an accident where the officer had reversed the names of the people in the cars, and got the makes of the car wrong... the judge stated that general idea of what happened was still intact, and the full charges stood.

  4. You likely will be out of luck, remember anyone can change the date/time stamp on a camara!  That being said, if you can verify what company is doing the road word at that place of construction, you may be able to get a company repersentive to give an afidavid stating the company had no workers at the site at that time, on that day.  Other than that, you will likely still have to pay a fine for the 83 in a 55, as the rest of the information is of no importance to the offense!

    The only way you may get off with just taking a defensive driving course, will likely be if you hire an attorney...which may cost more than the ticket!

    As to the color difference, it won't matter, the number of passengers, will only help you, in that you have them as witnesses to testify there were no workers in the construction zone at the time of the ticket!

    He might count himself as a worker in the area

    2 or 3 passengers irrelevant to speeding

    color, just a perception depending on the brightness of the sun

    Your attitude must have worked against you, or he wouldn't have been so "less than nice"
