Does innocent until proven guilty only work in court? I have a cop that will not help me retrieve a vehicle I have paperwork for because the woman is saying we stole the title... He wants me to get a copy of the title from sec of state (which takes weeks) before he will help me I have all the paperwork I need besides that copy. The car is in my name registered insured plated and I do not have possession of it. why shouldn't she have to produce the title why do I have to wait to get my vehicle until then?? WHat if she destroys it by then? I want to report it stolen but this ONE cop is holding everything up until he sees the copy of the title. I have other documents stating that I own the vehicle (from HER) what can I do??? PLease help

  1. Whos name is on the title? If it's your name the it's your car. If it is still hers then it is hers unless you have a reciept to prover you bought the car from her. Not sure what state you are in but here you no longer can regisiter a car unless you own it.  


  2. If the car is yours why do you not have posession of it?  You didn't explain that part.  You should be able to purchase a duplicate title from your DMV or DOT.  They'll have electronic record of it and it should be easy to get.  

  3. A police officer cannot not help you with that situation. Even if you got your copy and went to the house to retrieve your property. The person that owns the property can tell you and the police officer to get off their property. You need to go to court and file for a sequester.

  4. A police officer can't get in the middle of a civil dispute unless there is criminal activity involved and a police officer cannot prevent you from filing a stolen vehicle report.  Until charges are filed against her, the burden of proving that this is your vehicle (by having the title) is on you.  And, yes, innocent until proven guilty is a legal concept and only applies in a court of law for the person charged with a crime.  

  5. Copy of Insurance of the car in your Name, should be able to get that in 1 day. Then if still held up by police officer, ask to see the chief to file stolen report. If still held up go to Local Distric Attorneys office to file criminal charges yourself, you can do this also at the local District Court at the clerks office without the police. Becarefull, if you are not truthful you risk being prosecuted for maliscious procesecution and perjury.
