Ins. question: Whats my next step?

My claim was denied by an insurance company. Someone hit my car. The jerk who did it gave a different story to her ins. co..she drove off and I had to follow her in order to get her insurance info. I filed a police report and had 2 people in the car with me. They still denied the claim, because she told them something else. I notified my insurance company, they told me if there was an issue to call them back, I just can't afford the 500 bucks (deductable) right now...what do I do next?

  1. Unfortunately it si probably going to come down to the police report.  Unless she received a summons from the police due to the accident her insurance company isn't going to pay anything.  You insurance company is supposed to do their own investigation on the accident and if they feel the other person was at fault they will try to negotiate/litigate payment.

Just talk to your insurance agant and see if there is anything they can do

  2. OMG you ok first of all? How bad is the car damaged? I don't understand why they would denied the claim if you have a police report plus witnesses. If you could maybe contact a lawyer and maybe they can help you out

  3. Honey, this is  pretty much your fault (not trying to be rude) Whenever you're in an accident, you do not leave the scene until the police have been called, a report must be filed on the scene of the accident or else it's just your word against hers. Why did you drive away without calling the police? Even if you made a report after the fact, that won't do you any good when it comes to insurance. Honestly, you're probably screwed in this situation. Good luck.
