Instead of fixing my car, how can i get my car insurance company to issue me a check for the damages?

My 1996 Lexus ES 300 with over 200,000 miles was hit (not my fault) on the rear drive side tire well. I got an estimate for it, and it was approximately $2,900 before tear down. Seeing that my car may not last any much longer, how does one ask for a check for the damages to the car? My insurance is AAA.

If you were hit,  you should get a check from the other party's insurance for repair,  If you don't know who it was that hit you,  (in a parking lot and it was hit while you were in the store) your colision insurance will cover it up to the actual cash value of the car.   If the damage is more than the vehicle is worth,  they will total it.    You shouldn't have to ask them for a check if you reported it properly.


  2. Have AAA inspect your damages and tell your adjuster that you want to cash out. Sell your car to a Private party after cashing out because AAA will not insure you without fixing the car.

If the other guys insurance is paying they will make out a check to you.  If it is your insurance company that is paying, they will fight you tooth and nails and will insist on paying the repair shop.   You legally can make them issue you the check but you will probably be unsuccessful...     Remember that NOT ALL kind of insurance will pay for that kind of damage.

    But if the other car that hit you didn't hit-n-run, then you should have gotten their insurance company info and you can file a claim against them - which is always covered.

  7. Im assuming you don't still owe money on your car? (b/c if you do.. you have to get your car repaired- you don't have the choice to just get a check)

  8. Well, you tell them you want them to issue you the check.  Likely, they'll drop the collision and comp coverage off your car, if you don't fix it.

    I'm assuming you don't have a loan on the car.  But I'm a bit surprised that it's not a total loss.

  9. It sounds like you feel that your car is totalled. If the person that hit YOU has insurance then, of course they will have to fix the car to your satisfaction. You need an estimate that states that the damage is considered "totalled".

    Then, they issue you a check for the value of the car (before the accident) based on the Blue Book value. This will have to be more than the estimate to repair. You will have to surrender the car to the insurance company. You'll get a check and you can use that toward another car.
