Insurance Policy?

I own an apartment in a block of 18 apartments and yesterday an elderly resident of one of the apartments slipped on the stairs leading to the garage area..can they sue us? or is it covered by the building strata management??

  1. Of course they can sue anyone who has any interest in the property.  This is why you need liability insurance.


  2. it depends what her allegations are.

    she can try sueing the strata company if she believes that the strata company did or didn't do something that caused her fall.

    i doubt an individual resident is responsible for the maintenance of the stairwell, so it's unlikely any one person would be pointed out to be sued personally.

    if the stairs were lit and not in a state of disrepairs and have no obvious trip hazards, then she should have taken more care for her wellbeing.

    liability is based on negligence.  if there was no negligence, she won't succeed.

  3. Look in the phone book and see the millions of lawyers that specialize in 'Slip and Fall' cases. It will be your insurance co. they sue unless of course you have none then you'll be screwed.
