me and my wife are going through seperation and all of a sudden today she took my truck we both live at different adress. The insurance was in my name but the registration is just in her name she is in the navy and Im a civilain. There is still a lein on the vechile because we have not payed it off yet. I called my insurance company today and told them to cancel my policy what is going to happen to her if she gets pulled over is the dmv going to cancel her plates and suspend her licence? Im not on the registration so the insurance company said I would not be in trouble if they canceld the insurance on the vechile. My other question is that I have another vechile but both of are names are on the title and the registration is there any way I can take her name off the registration with out her being there or vis versa I want her out of my life what can I do so she doesnt take my other vechile.

  1. 1. It would be better for everyone if she got insurance in her name (to take effect when you cancel the insurance that is in your name) than if you cancel the insurance first and she drives without insurance.

    2. As far as the vehicle that is in both names, you need to get the divorce court judge to decide who gets that vehicle, then bring the order from the divorce court to the DMV with the existing title and registration and have them reissue the title and registration in the name that the judge indicates in the order.


  2. Worse yet, if she gets in an accident, she and the truck are not covered. You, because you are still married, could be liable to some degree because you are financially tied together. You need to give her the courtesy and tell her you canceled the insurance you were paying. If she wants the truck, then she takes the loan and its payments. She needs to release her interest in the vehicle on the title with her signature.

  3. If she gets pulled over, she'll show the "proof of insurance" card in the glove box and nothing further will happen.

    The lienholder will buy a policy that covers their interest, and charge it to whichever of you made the note, and the cost will be outrageously high.

    About your other "vechile", see a lawyer.

  4. Well if you live in California she could go to jail and the truck will be impounded. Having an insurance card to show doesn't mean anything. They CHP and Local Police can verify it as soon as they call in the plate of the car
