Insurance check from car wreck?

just wondering how much the check would be from the insurance company? (for pain and suffering) i was in a hit and run and the driver was drunk, (this is coming from that guys insurance company AIG) i went to the doctor about 3 times over a sore shoulder im clueless any info is helpful thanks

I've seen insurance companies pay as much as $2,000.00 for something like this just because they didn't want you to hire an attorney and sue for your pain and suffering (punitive damages).  If you accept a check from them for any amount, this means that you forfeit your rights to any future claims on them for any reason. You need to see an attorney right away. Don't wait. The longer you wait, the less likely you will get a settlement from them.


  2. With these facts, you are absolutely STUPID to accept ANYTHING offered by the guy's insurance unless you have a lawyer.

    They will offer you a small fraction of what your case is worth, and make you think they are doing you a favor.

    GET A LAWYER!

    Personal injury attorneys all offer free consultations, and handle injury cases on a contingency, that is. you pay them nothing yourself, they are paid out of the recovery when the case is completed.

Most likely you will get 3 times your expenses or should I say that is how much the other insurance company will pay.  Your Lawyer will keep 1/3, you get 1/3 and the rest go to paying medical bills, if you already paid them then great you get that 1/3 if your insurance paid most of the bills then plan on them coming for their share, if you just got a sore shoulder you better just stick with the out of court settlement described above b/c a jury is not going to award you some big amount of money and may even decrease what you get then you pay more lawyer fees and other ungodly costs and end up with NADA.

    There is no chart or formula to tell that.

    It sounds like you have a soft tissue injury. That's not going to be a big money claim.

    The best thing to do is to keep the lines of communication open with your adjuster. The negotiation process is give and take. They will make an offer - and you counter offer.  By listening to each other -- you reach a number that you both agree on.

  5. Maybe nothing.  If your shoulder is sore, but there's no real injury, you'll be lucky to get $100.

    If you're in a no fault state, you'll get nothing.
