Insurance claim workers comp.?

what will happen if insurance ,for workers comp. doesnt accept the claim but i got a lawyer???

If Workman's comp doesn't accept your docs report they will send  you to there doc. your lawyer will talk with work comp

If they don't agree to it then it goes to work comp court

work comp court is nothing like the regaler court system

what happens is your lawyer and there lawyer will talk

to the judge. The judge has the last say about it if they can't work something out. work comp pays for court costs  so 9 times out of 10 they will work something out  before court

It doesn't sound like your in CA. In CA you only see one doc

and he is of your choosing. then if the workers comp don't like what they here then its off to court. Thanks to are Governor

Arnold  he singed a bill that gives the injured worker less

benefits in retraining and compensation. It saves the insurance

and the employer money.

Hi,The workman compensation is a liability insurance and it always decided by the court.You just go to the court the court will decide the claim.Nothing to worry.

If your claim is denied than you have the right to file for an appeal.  The denial language normally states your rights as an injured worker.  You can do this yourself or an attorney can do this.

Since you got an attorney all medical records and correspondences should be sent to your attorney.  Each state is different on what is provided.  You will go through IME's, your doctors and other doctors will go through depositions after depositions, hearings will be postponed  and there will be mediations.

Generally most states are claimant oriented (injured workers) but each case is different.

If the claim isn't accepted,  the lawyer will go to court and have a hearing.  The judge will decide if you get the benefits or not.  It can take six to eighteen months for that hearing to happen.
