Insurance claims adjuster lawsuits??

I am thinking about doing a short stint with a car insurance company as a claims Adjuster. My question is whether or not clients can sue the claims adjuster? If they can does the insurance company back the claims adjuster in these lawsuits, or is the claims adjuster out to defend themselves. I am not planning on becoming one if theres a possiblitly of an independant lawsuit. thanks.

  1. I've never heard of an individual claims rep getting sued by a customer or claimant. If it's one of your customers that thinks you've treated them unfairly, they'll file a bad faith lawsuit against the company. And if it's a claimant that doesn't like the way you've handled things, they'll get a lawyer and sue your insured...which your company will have to defend.


  2. Anyone can sue anyone else for any reason. However, if a client is not happy with your determination of a claim, they go after the insurance company, not the employee. As long as you do your job judiciously and treat clients fairly, you should have no trouble.

    I'm insured by State Farm, and in all my dealings with their claim adjusters, I have always felt that I was treated fairly and equitably. There are probably companies that are not as good, and they are bound to have complaints if they try to skimp by saving money at the expense of a car accident victim. As long as you have empathy for the client and understand the problems that a claim entails, you should do all right.
