Not really, your claim has gone this far because of legal issues that has never been addressed before.  If your looking for a bigger payout than I suggest you ask your lawyer, if you have one, to contact the adjuster and settle this before it goes any further.  Because your case has gone this far up you risk the chance of losing everything.

No.  Courts aren't about getting MORE money, with workers comp.  Payouts are pretty strictly guided by each state and the law - the time the courts come into it, is if the insurance company is flat out denying the claim, or says you can go back to work, and you disagree with it.  

You don't get pain and suffering with workers comp - it's strictly about medical bills and lost wages.  If you're permanently disabled, then state law dictates how you get paid, based on your wages and your age.
