Question:

Interview notice but no EAD?

I have a pending adjustment of status. A few days ago I received a notice for my initial interview, which will take place in September. But I never receive my Employment Authorization card. I thought that I'm supposed to get the EAD first after finger printing and then I'll get the interview notice. Is this normal?

  1. How long has it been since you applied? I applied in March and received my EAD in May...two months later. But i didn't receive my initial interview letter until July. Maybe if the processing times aren't very long you end up getting your initial interview before your EAD is approved.

  2. I filed mid-May too and I already got my EAD card 2 weeks ago. Normal processing times of EAD should be 2 months. Some of my friends who hasn't got their EAD yet made an Infopass appointment. You can learn the procedure in www.uscis.gov.Another thing, if your interview will be on September which will be next month and you get approved, the green card will now supercede the EAD card so maybe you can just wait for the green card. But if you are wanting to apply for a job soon, I suggest you make an Infopass.Lastly, it's different offices that processes the AOS and EAD. AOS is processed by a USCIS Service Centers while EAD is processed by National Benefits Center in Lees Summit, MO.So, it is not unusual that your AOS and EAD seem to have different pace in its processing.

  3. EAD decision should be made within 90 days from your Receipt Date. If you filed mid May, you still need to wait until mid September for EAD. However, if you get your green card approved first at the interview, you don't need EAD to work. Your green card will be work permit.
