Involved in a Hit&Run. Caught the guy. Will insurance cover damage to rims, transmission, & accesories?

I had my car parked at the corner. Me and my girlfriend had fallen asleep. We were hit by some drunk drivers from behind who had run the stop sign and had tried to avoid the dips. They totaled the whole back of the car and there were some other damages to the rim and the transmission. Also, the whole car is all bunched up like a crushed can. My girlfriend was injured in the accident. I only caught the driver. What would their insurance cover (if they even have any)?? What can i get out of them in court if they don't have insurance??

  1. Have your insurance company handle your damage if you have collision coverage.   It is much easier that way.  Give your insurance company the drivers info and let them go after him for his insurance and your and their money back.   Let your insurance company do all the work.    

    If you do not have collision insurance then you will probly have to sue him in small claims court to get him to pay or his insurance co will pay.    If you have uninsured motorist and it turns out this guy has no insurance your insurance will pay with no deductible.

    Bottom Line, Call your insurance agent or company for help first and put the claim in with them.   That is what you pay them for.

    Liability coverage is damage to others that is your fault.

    Collision is damage to your vehicle, that is your fault.

    Comprehensive coverage is damage that is not your fault,,,,deer in road, branch from tree that fell, shopping cart, hit and run driver......check your policy.

  4. Sounds like your car is a total loss -- the insurance should pay the market value based on model, condition, options and mileage. I suggest you just file a claim with your own company -- they will do all the work for you and return your deductible when (if) they recover from the drunk.

First of all your insurance will cover it if he doesnt have insurance.Of course you have to fight because they will try to raise your insurance if your own company has to pay.The best thing to do is let your insurance company handle this but keep up with it.Your insurance company has a whole staff of attorneys to handle this.They want their money more than you want yours.I assume you got his insurance information.If not it should be in the police report or the police have it.Call his insurance company and file a claim.Have the police report before you call so you can debate whatever they say.They will try to get out of it.Call your insurance company too and tell them what happened and give them all the information you have.The bottom line is as long as you have insurance all your damages will be covered less your deductable.THIS PART IS VERY IMPORTANT! You are allowed to have your car fixed wherever you choose.Before you have the body shop fix your car ask them up front if they will do it without you paying the deductable.Almost always they will and it is perfectly legal.Search for a repitable body shop and make it known to them you are looking for someone to fix it without you paying the deductable.If his insurance covers it you dont have to pay anything.

  6. if you have rims like really expensive ones or accesories  your insurance company wont pay because thats considered a alteration when you file your claim they might want to see the car if not do not mention rims at all but they will help with the damages
