Ipod touch Question, HELP

Ok so I'm trying to decide if I should buy this 16G ipod with the old software version or this other one with the January software update .. the this is that.. the one with the old version costs $339 and the one with the new software version costs $ 380... which one should I get? is there a physical difference between both often as in the outsite or it is jsut the software? do you think it would be easier, jsut to get the $339 one and just update it on apple for just 9 bucks? .. help

yeh, get the old one and update on itunes

Get the one without the update, and buy it from apple for 10 USD, save 31 USD.

Just to let you know i recently bought an itouch for myself, and there really is no need to jailbreak it, there are really a lot of cool features on the app store from apple!

Without! You can get the upgrade for $10 from Apple.com. Also they have referbished ones with it on there already for $299.
