Irish national child is born on US soil. ?

Is it ethical for an Irish mother who is pregnant to go the United States as a tourist for the sole purpose of giving birth on US soil, in order for her child to be a US Citizen? As soon as her child is born on US soil she goes back, to Ireland with her child, to be with her husband and her child father. She has not violated US Immigration law by doing this. She also paid the hospital bill in full before going back to Ireland.

  1. Most women cannot fly after their 7th month.  Hope she's planning on a long visit.  


  2. This would seem legal but is NOT ethical. It is taking unfair advantageof a loophole in American law which needs to be closed.

  3. One problem. You most likely would not be let in! Most countries that have jus soli laws do not allow pregnant women in just because of this!

    You (Americans) have brought it on yourselves.

    Im Irish and the law in Ireland used to work the same as in America.

    If a child was born in Ireland they were citizens regardless of where their parents came from.

    Then we started having problem with illegal immigrants coming to Ireland having a child and then claiming the right to stay because the child was a citizen.

    So in 2004 we changed the law.

    Since 2004 a child born in Ireland is not automatically a citizen.

    The child is not a citizen unless-

    - One or both parents are Irish citizens

    - One or both parents have had legal residence for at least 3 years before the the birth

    - One or both parents have been granted asylum seeker status

    So the child of tourists born here is not a citizen, nor is the child of illegal immigrants.

    Untill you change your laws in America you have no one to blame for the situation but yourselves.

    I honestly dont understand why the laws arent changed since the whole "anchor baby" phenomenonon is a much bigger issue in America than it ever was in Ireland.

  5. I don't think it's ethical but the law allows it.  If a US citizen mother wanted to go to Ireland as a tourist to have a baby there so it can have Irish citizenship, she could.  

  6. automatically a US citizen if he or she chooses in the future and I believe Ireland allows for duel citizenry as well. The US does not allow for duel citizenry. The child will get to choose.

  7. Honestly, I think that's a misinterpretation of the constitution. Being born in the United States doesn't make you a citizen, especially if that's the only credential you have. If you're born here, then raised somewhere else and never taught anything about the United States, does that make you a citizen? Most countries require people taking citizenship tests to at least know something about the culture.

  8. Yes, it is unethical. She is getting citizenship for her child. Why would she want American citizenship for her child if she lived in Ireland?

    Maybe because she wants citizenship and will use her child to get it instead of doing it the long legal way?
