  1. Yes, technically.  But not really.

    The first version of the iPhone was hacked soon after released and allowed those users to find another GSM carrier to use the iPhone with (in the USA that would be T-Mobile or any other GSM network).  Many people bought the phone, activated it and then cancelled their service - opting to go to other carriers for their service.

    NOW, Apple and AT&T are forcing customers to sign the contract BEFORE allowing the phone to ever be turned on.  This really pigeon-holes the customer into staying with AT&T for the entire 2 years.  Over the course of the 2 year contract you're looking to pay $1,680 (before taxes are applied) based on the cheapest iPhone plan.
