Is Bristol Palin's" baby's daddy" 26years OLD ???

I saw on an Answers post,,that CNN reported the "Baby's Daddy" of Sarah Palins (McCains pick for vice president) daughter Bristol,,is 26years old..Is that correct?? Because if it is,,wouldn't that be considered statutory RAPE since the daughter is 17 ??I don't know,,about Alaska,,but that's what it is where I live.. L H
