Is Green Card still good because of my kids?

I am going to get divorced from my American husband.Both of my kids where born in the US.Is my Green Card that I got for beeing married to an American still good because my kids are Americans?

  1. It is still *good* regardless of your children.

    You are a permanent resident of the United States until an immigration judge decides otherwise, your divorce does not affect anything.

    The real questions comes if you have not yet removed the conditions of your green card and that is really just a timing concern of *when* you can file to remove them.

    So don't worry about it.


  2. Your green card has nothing to do with your kids, it all depends on the length of the marriage.

  3. Once you were married the 2 years and then obtained your permanent green card, you have a right to get divorced and stay in the US.

    It doesn't have anything to do with your kids though.

  4. How long have you been married? If it was for more than two years, and the BCIS released the provisional aspect of your original green card, you should be all right.

    Are you a battered spouse? The INS Code has a provision for legal immigrant status for a battered spouse.

    Otherwise, since you have dependent US citizen children, you may qualify under the Family Unity Act.
