Is It Legal for an 18 Year Old to Kiss A 14 Year Old?

my friend was hanging out with her brothers friend. he is 18, she is 14. he told her he liked her very much. he held her hand and she didn't want to and didn't let him and she pulled away. he tried again. she said no. then he went to sleep over at her house. she woke up at midnight and out of nowhere, he kissed her. she told him not to.

then he tried to put his tongue in her mouth. and she told him to stop.

and eventually he did.

now she told me about this, and i was enraged. i told her to report him but she says she doesn't know what to do. i told her its illegal and he can go to jail and he touched her. is it illegal or not?

and what can i do about it?

i think you should report this i mean he did it to her who else  will he try to do this or even get further with the next girl.because he would think he can get away with it,so i think you should report it,because he is of legal age and she is a minor so  do something about it.

That is, at a minimum of assualt, if there was any touching could be sexual assualt. When it concerns a monor, it can be aggravated assualt.

I don't know what state you're in, it probably won't matter. No, the age difference won't matter much, in terms of "statutory rape," but this is still a very serious crime, called Sexual Assault. Not as bad as rape, but still very serious.

What you can do: Talk her into reporting it, or maybe filing a civil suit (restraining order). You could try reporting it yourself, but that comes at some risk that this guy can come at you for defamation if she changes her story later and denies it happened or says it was consensual.

An 18 year old could share a consensual kiss with a 14 year old in most any state, but if it was not consensual, the age will not be a major factor. It might be a little worse because the charge might end with the words "of a minor."

Firstly, dump your friend.  He is sick and will cause further problems. I do not recommend that you report this because it will cause you a great deal of trouble.  You will have to go to the police and swear out a warrant for his arrest.  If he is caught he will be locked up. He will face a trial and he could go away for a long time.  It isn't worth it because there isn't rape involved.  For all I know the police may just blow it away. Just stay away from the people who are involved in this act.

sounds like you need to get child protective services involved, start by calling the sheriff to take a report.
