Taking into account that Saddam Hussein committed the same crime genocide against their own people, and was hanged.

  1. He's neither, ordering his armed forces to storm Tskhivali is a war crime. The crime is ethnic cleansing, not genocide, it's pretty clear they were hoping the Ossetians would flee to Russia. (Saakashvili has in fact stated he wanted Ossetia and Abkazia to stay in Georgia but not the Abkazians or Ossetians.) He's mostly a blustering fool, he must have thought the Russians would back down with the USA covering his back. He was wrong about both.

    So he's a war criminal, just like dozens of world leaders.
