Is NOC really needed in order to waive for labour ban?

My previous employer will not give me NOC and I've been dealing with my new job hunting very hard because of this. Where can I directly ask about the labour ban due for me? Is NOC really needed so it can be lifted?

  1. Employees seeking transfer of sponsorship have to obtain a NOC from the previous company.Without the NOC, an employee will have to take a forced break of six months.

    In other words, the worker will be banned from working for six months.

    With the NOC in hand, the worker or his new sponsoring company can approach the authorities concerned to regularise his status.

    The NOC is the green light for starting the series of procedures for a new work permit. If the worker starts his job with the new company without the NOC he will be subjected to a one-year ban.

    When an employee finds a new job opportunity and wants to quit his current  job he will have to first approach the typing office at MoL with an application of transfer of sponsorship.

    The fees of this application depends on the applicant’s profession and the category of the new company.

    The ministry’s approval of the request is to be followed by the approval of the ex-sponsor, which implies the NOC.

    Then the applicant should go once again to MoL to pay Dh5,000 fee for transfer of sponsorship and apply for a new labour card.

    The new sponsoring company has to bear these expenses.

    After the results of the medical test, MoL transfers the employee’s file from the old company to the new one.

    It also sends a letter of notification to the Dubai Naturalization and Residency Department.

    MoL, however, noted that the NOC was not restricted to a particular category of workers.

    You also made don't have to leave the country in case of sponsorship transfer. Only when the labour card is cancelled and no job opportunity is available, you have to leave within 30 days.

    Otherwise, you will be considered as an illegal. Within that 30-day deadline if you find a job and want to stay in the country hyou can pay the so-called departure fee. It spares you from going out of UAE.

    In case your employer refuses the NoC and no amicable solution can be found, you can contact MoL on the 'Open Day' on Mondays to submit your queries. You also can call MoL toll free under 800665.

    The Ministry of Labour usually asks the sponsor about an NOC letter regardless as to how long the employee has worked for the company.

  2. I've been working in Saudi Arabia for 2 years and I was able to finish my contract and they even give me an NOC. And then right now I'm on my way to get back again to the country. And it seems there is no problem with me whether I wasn't able to secure NOC. The important thing is you have finished your contract and yo don't any obligation from your previous employment. Its in Saudi  hope its the same with the other Middle East country.

  3. yes, NOC is really important or you'll get 6 months ban by default or may be one year, you can move to freezone, try to find a job in freezone companies you'll not get any ban.

    try to talk to some typing centres they'll have more details on this.
