Question:

Is a SWPP and Monitoring Plan required with a California NPDES No-Exposure Exclusion?

Reading the NEC form, it looks like you need to attach a SWPP and Monitoring Plan to an Notice of Exclusion. Isn't this a catch 22? If I am exclusing myself from the permit, why the plans?

  1. The form is an all purpose form.  If you have received an exclusion from the state and more importantly from the local authority whether it be the firemarshal or the county DEQ, simply submit the exclusion and keep it on file at the facility.  You obviously dont need a SWPP if your facility is excluded.
