Is a divorce decree a legal and final decision on debt?

My girlfriend's divorce decree says that her ex is responsible for all debt on a motorcycle they bought a few years ago. The ex hasn't paid on it and she is now being sued by the creditors. The creditors lawyer says that the divorce decree doesn't stand, that THEY have the say on who owes the money. Is this right?

  1. Regardless of what the decree states, a prior committment to the lendor (such as a signature promising to pay a debt) can not be nullified by divorce court.

    (unfortunately speaking from experience)


  2. All you can use the decree for is a weapon to hold his feet to the fire to resolve it or be held in contempt of court and let the judge work on the guy.

  3. She is responsible if she co-signed.  What she needs to do is pay off the creditor and then take the ex back to court and sue him to get her money back.

  4. It's true. As long as she was a co-signer for the loan, she is responsible for the debt until it is paid off or the creditor forgives the loan. A divorce decree can't change that.
