I am in Illinois and my question is for Inmigrations purposes because I heard that you can be deported for aggravated felonies ir you are not a citizen.

  1. Aggravated usually only kicks in if someone was injured or there was a threat of force on the part of the thief.

  2. To the best of my knowledge, retail theft becomes a felony when someone attempts to stop you from stealing physically and you assault them or continue to try to escape.  I could be wrong about this, but I used to have off-duty police officers do security at my last store and this is what one of them told me.   However, I don't know what the difference is between a regular felony and an aggravated felony.  Is there a difference?

  3. There is no such thing as felony retail theft.

  4. There would need to be an assault/batttery or a weapon involved.

  5. Was someone assaulted during the crime?
