Is a guardian ad litem "the court," as some claim (for purposes of WA's Public Disclosure Act (chpt 42.56 RCW)

WA enacted the Disclosure Act to insure its representative government could be monitored, however, court administrators and others frequently site Nast vs Michaels and claim administrators and others are "the court," to excuse their agencies from disclosing public records. Note that even judges are distinguished from the court (ref. chpt 2.08 RCW).

  1. A guardian ad litem is NOT the court.  They are separate and are standing for the child only, separately from the court, the petitioner or the defendant.
