Question:

Is a home seller required to disclose prior accumulation of bird f***s within the home?

I am considering an offer on a historic home that was in the process of being renovated when the current owner ceased the process and decided to sell as is. The home has been vacant for 4 years and has served as a pigeon roost. Until this week, there was roughly 3 inches of bird f***s covering the upper most floor and numerous dead pigeons on all three levels. The owners recently had a cleaning crew remove the f***s (but none of the day laborers had any of the required OSHA protections -- OSHA has specific guidelines and considers this a hazardous waste removal). I wonder if the seller would be required by law to disclose to any future potential buyers that the house had previously been contaminated as it is impossible to tell whether or not all potential danger has been completely removed. Also, it is clear that they did not use a qualified exterminator/cleaner. Thankfully I know about this and am hoping to turn this into a deeper discount on the house.

  1. Any contamination that has toxic

    capability, [ergo, OSHA control],

    must be introduced on the sales contract.

    Before i made a serious offer

    [or accepted the house after an offer]

    I would put in writing that the owner must

    pay for a "licensed Hazmat" inspector

    to review the home for toxicity from

    birds.

    Unique but its in the law.

    I would find another house for a back

    up deal...........
