Question:

Is a honeymoon a valid excuse to apply for advance parole?

I am a US Citizen marrying a immigrant this year. Because of her status, she cannot leave the country "no visa, no papers". She does have a valid passport of her native country. Since we know the processing times of applying for residency, if we were to apply for a travel document "advance parole", would they grant this to us if we wanted to simply go on our honeymoon, rather than wait 6-12 months for the green card?? I understand the travel document can take a few weeks to a month or two. It seems we should not leave the country even if we get approved for the advance parole so we were thinking of going to Hawaii.

When I do fill the form out, what should I put as a reason of obtaining such document? Just being honest and put honeymoon?? instead of putting emergency or something of that nature. What would be the reason of being denied?

  1. nope. it has to be an emergency. wait until her papers have been processed for the honeymoon.

  2. Just be honest and upfront.  If you need to wait for her papers then WAIT!  There are a lot of nice places within the U.S. borders to honeymoon, why not choose someplace she hasn't seen?  If she's a new immigrant she should be eager to see the continental U.S.A.!!!

  3. You can find more information at http://USCIS.gov/. There is a good chance if you leave the country, she may not be allowed back in.  The original visa is usually a "one time entry" visa.
