Is a misdameanor the same as a felony? Will a misdameanor be on my records for life?

Bottom line, when asked 'if convicted of a felony,' would the correct answer be yes or no if the crime was a misdameanor?

  1. You would reply no.  Misdemeanors usually don't stay on your record forever.

You didn't say where you live, so it's difficult to give an exact answer.  In America, criminal issues are generally a state matter.  When I was living in New York, a misdemeanor was any crime for which the maximum jail penalty was less than 1 year, while a felony was any crime where the maximum jail time was over 1 year.  If there is only a misdemeanor conviction, you can answer the question 'no'.  

    As far as the records go, that can also vary from one state to another, and may also depend on the age of the person - minors have different rules than adults.  But IN GENERAL a criminal conviction will always stay on your record unless you can get it expunged by the courts.

  3. Doesnt ur question answer itself. If they are asking about felonies and u only had a misdameanor then ur answer would be NO. U can get ur record expunged and have the misdameanors taken off  

  4. Felonies are much more serious than misdemeanors and most laws/rules affecting one's "record" are based on felony convictions.  If the question is as you stated, the correct, simple answer would be "No."

  5. No, a misdemeanor is just that, a naughty thing. after six months it's history. word of advice, check no on that one....
