Question:

Is a permanent resident OR someone on a student visa allowed to adopt an US child?

My husband and I will be moving to the US in the next year or two. As yet we are uncertain what visas etc. we will be going on. Most likely I will have a student visa and my husband will probably have an employment based permanent visa. Will either of these visas allow us to adopt a child?

  1. God I hope not... visa is not permanent so adopt a child let the child get attached. Then something goes wrong you leave the child stays.. losing yet another set of parents.

    Do you think that is fair? Why the h**l do other people not think of the children and just themselves?.... God no wonder these children are suffering this fate.

    I have seen others say this: These are children not puppies.! (Well said..)


  2. I think so.  My British adoptive parents were on visas when they adopted me in the United States.

    Loads of American kids are being 'exported' at the moment because the American Paps are overlooking them and going abroad to adopt.  It doesn't really make sense to me.

I have heard that a lot of non-citizens take advantage of the abundance in the US while here on VISAs.  I know one couple who used the outstanding orthodontics here to get their teeth and the teeth of both of their children straightened.  I know another couple who were able to save enough money while in the US so they could afford to buy a house when they went home.  I know others who load up on cheap electronics and get plastic surgery.

    h**l, why not pick up a kid or two while you're at it?  That way you can return back to your country and not have to be bothered with the children's first family ever again.

    If I understand your situation - you are looking to adopt.  Since you are planning to be in the US for a number of years it makes sense to adopt in the US rather than wait until you're back "home".

    As far as I know, there are no restrictions on non-US citizens adopting US children.  The fact that you'll be staying in the US for a while will be in your favor.  Would you consider an open adoption?  A "special needs" or older child?  Make sure you are well informed of the child's family situation.  There are some unscrupulous people out there who are more interested in "obtaining product" than finding a loving home for a child in need - don't be fooled by marketing ploys - these kids weren't found under a cabbage leaf - there are real families out there.  Make sure you know the true and complete story.

  5. If you have a permanent residency visa, you can adopt.  You cannot adopt if you have a student visa.  I have to say though, that I don't know how easy it is. Every permanent resident that I know who adopted did so from from their home country after moving here.
