Is a tenant responsible for water damages caused by snow or bad weather?

my landlord took my security deposit cause the kitchen wall had a vertical slit that was caused by the roof leaking after a major snow storm.

  1. No the landlord has insurance to cover such things. You could take them to small claims court to recover your deposit.  But you may need documentation or proof of the wall damage.  


  2. She is a lousy landlord.  If you put her on Judge Judy,  Judy will roast her.  

    This is what changes people from renters to owners.  Keep your eyes open and see if you can buy a house.  You would never let leaks ruin your own house./

  3.       The landlord is usually liable for damages caused by the natural elements. Exceptions may exist, if you failed to promptly notify the landlord of an existing leak,  need to shovel snow from the roof or freezing of the gutter system.

          If you were without knowledge of weatherization problems, the landlord is improperly behaving. At the lease end you may want to go to Court to recover your deposit.

           Communicate with your landlord. Write down your position inform your landlord that you do not accept the landlords actions as proper.

    WARNING- This may bring forth your eviction so be prepared. Your legal defense would be this is a retaliatory eviction because if you otherwise complained to building and safety, the inspectors would have ordered the premises repaired if not torn down....

  4. You could be, if your lease states you will take reasonable care.    It sounds like damage because of neglect to me.   Aren't you supposed to remove snow from your roof?

    However, I do not live where it ever snows.   Common sense tells me you remove snow, it is heavy and will eventually melt....but maybe I am wrong.

    If this really was weather related the landlords homeowners insurance will cover the damage.

  5. Read your lease.  Unless you are responsible for snow removal from the roof to prevent damages, he should of not kept your deposit.
